Clear terms, no fine-print games.
These are the simple ground rules for using our website and portal. They’re written to be read — and they sit alongside the separate NDIS Service Agreement that covers your actual supports.
This is general information, not legal advice. If anything here is unclear, please ask — we’d rather explain than leave you guessing.
Acceptance of these terms
By using this website (gencareservices.com.au) or our participant and family portal, you agree to these Terms of Service. If you don’t agree, please don’t use them. These terms are between you and Gencare Disability Services(“Gencare”, “we”, “us”).
What these terms cover
These terms cover your use of our website and portal — browsing information, submitting an enquiry or referral, and using an account. They are not your NDIS Service Agreement.
The disability supports we deliver are governed by a separate NDIS Service Agreement entered into after a personal conversation, which sets out the services, pricing and arrangements specific to you.
Accounts & eligibility
To use the portal you must provide accurate information and keep your login secure. You’re responsible for activity under your account. Please let us know promptly if you suspect unauthorised access. We may suspend or close accounts that are misused or that pose a safety or security risk.
Acceptable use
When using our site and portal, you agree not to:
- submit false, misleading or spam content, or impersonate another person;
- upload anything unlawful, harmful, or that infringes someone else’s rights;
- attempt to access data you’re not authorised to see, or probe our security;
- scrape, copy or harvest data, or disrupt the service for others.
Intellectual property
The Gencare name, logo, written content, design and code are owned by us or our licensors and are protected by law. You may view and share our public content for personal, non-commercial use, but you may not reproduce, modify or republish it without permission. Content you submit (for example, a referral) remains yours — you grant us the permission we need to process it to provide our services.
Information, not advice
Information on this website is general in nature and is provided to help you understand our services and the NDIS. It isn’t medical, legal or financial advice, and it isn’t a substitute for a personal assessment. Every support we provide is tailored to your NDIS plan and goals following a conversation with you.
Disclaimers & liability
We work hard to keep the site accurate and available, but we provide it “as is” and can’t guarantee it will always be error-free or uninterrupted. Nothing in these terms excludes rights you have under the Australian Consumer Lawor other laws that can’t be excluded.
To the extent permitted by law, we’re not liable for indirect or consequential loss arising from your use of the website, and our liability for the website is limited to re-supplying the relevant content or service.
Third-party links
Our site may link to other websites (for example, the NDIS Commission). We don’t control those sites and aren’t responsible for their content or privacy practices. Following external links is at your own discretion.
Changes to these terms
We may update these terms from time to time. The “last reviewed” date above shows when they last changed, and continued use of the site means you accept the current version.
Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
